By accessing or using the Website, the User accepts and agrees to be bound by the terms herein, along with the Company’s Privacy Policy and Listing Policy.

I. Nature of Service and Liability

• Platform Capacity: The Website is an internet-enabled electronic platform intended solely to facilitate communication, advertising, and distribution of real estate information. Radhanya Bliss is strictly a service provider and is not a party to, nor liable for, any transaction between Users, nor does it endorse, market, or promote any listings.
• No Advice/Warranty: Information provided on the Website is for reference only and does not constitute business, investment, legal, or professional advice. The service is provided “as-is,” without any specific warranty of results or outcome, and the Company does not guarantee the financial capability of any User.
• Third-Party Reliance: The Company relies entirely on information provided by builders/developers. The User is advised to exercise reasonable diligence, prudence, and independent verification before committing to any transaction.
• Limitation of Liability: The Company shall not be liable for any loss, damage, or liability resulting from any technical malfunction, reliance on User-posted content, unauthorized access, or the conduct of any User, whether online or offline. The User’s sole remedy for dissatisfaction is to cease using the Website.

II. User Obligations and Content

• Legal Compliance: The User agrees to comply strictly with all extant applicable local, state, and central laws and regulations while using the service.
• Content Authority: The User warrants that any information/content submitted regarding a property is provided only by the undisputed legal owner or a legally authorized representative (e.g., Special Power of Attorney holder).
• Prohibited Conduct: The User shall not violate the security of the Website, infringe on any third party’s Intellectual Property Rights (IPR), post illegal/obscene/defamatory content, use the service for harassment, or engage in SPAM activities.
• Verification and Suspension: The Company reserves the right to verify registration data and Content authenticity. Providing untrue, inaccurate, or incomplete information, or a breach of these terms, grants Radhanya Bliss the unequivocal right to suspend or terminate the User’s account and Usership immediately, without notice or refund.

III. Intellectual Property and Data

• IPR Ownership: All copyrighted material, trademarks, and proprietary information on the Website (except information in the public domain) remain the sole and exclusive property of the Company and its licensors.
• User Content License: By posting Content to any public area of the Website, the User automatically grants the Company an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, copy, display, and distribute such Content (“User Data”). All IPR related to content contributed by the User becomes the absolute property of the Company.
• Confidentiality: The User agrees to keep confidential all proprietary and confidential information of the Company obtained through the Service.

IV. Governing Law and Dispute Resolution

• Non-Resident Use: Non-Indian residents use the Website at their own initiative and risk, and by using the Website, they expressly consent to the transfer and processing of their data in India, governed by Indian laws.
• Dispute Resolution: Any dispute arising out of or relating to this Agreement shall be referred to a sole Arbitrator identified by Radhanya Bliss under the Arbitration & Conciliation Act, 1996. The place of arbitration shall be Gurgaon, Haryana, and the language shall be English.
• Jurisdiction: The Courts at Gurgaon, Haryana, India, alone shall have exclusive jurisdiction in all matters related to this Website and Agreement.
• Indemnity: The User agrees to indemnify and hold Radhanya Bliss harmless from any loss, liability, claim, or demand (including attorney’s fees) made by any third party arising out of the User’s violation of this Agreement.
